Terms of Service

These Terms of Service (“Terms”) govern your use of productcreator.ai and the productcreator.ai application (together, the “Service”), operated by B2B Minds s.r.o., IČO 22451765 (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Service description

productcreator.ai is a professional development and organizational diagnostic platform. The Service includes:

• Self-assessment: individuals rate their own product competencies against a structured framework
• AI assessment: an AI-powered behavioral interview that suggests competency ratings as a development tool
• Manager assessment: managers provide competency ratings for their direct reports
• Expert assessment: a premium service where an expert conducts a calibrated behavioral interview
• Organizational diagnostic: aggregated, anonymized view of an organization’s product capability

2. Development tool, not employment evaluation

productcreator.ai is a development and diagnostic tool. It must NOT be used as the sole basis for employment decisions including hiring, firing, promotion, demotion, or compensation changes. All assessment results are advisory in nature and intended to support professional growth and self-awareness.

Organizations using the Service accept responsibility for ensuring that assessment data is used appropriately within their context and in compliance with applicable employment laws.

3. Organizational diagnostic

The organizational diagnostic analyzes the organization’s product capability as a whole. It is not a tool for evaluating or profiling individual employees. Individual assessment data is only visible to the individual themselves unless they explicitly share it.

Organizations using the org-level diagnostic do so for developmental and informational purposes. The diagnostic shows aggregate capability patterns, not individual performance evaluations.

4. Acceptable use

You agree to:

• Provide accurate information about yourself and your role
• Use the Service only for its intended purpose of professional development
• Not misrepresent AI-generated assessments as human evaluations
• Not use the Service to make or justify adverse employment decisions
• Not attempt to reverse-engineer, decompile, or extract the assessment framework or AI prompts
• Not use automated means to access the Service (bots, scrapers, etc.)
• Not share access credentials with others

5. Data ownership

You own your assessment data. This includes your self-assessment ratings, AI interview transcripts, and any other data you provide to the Service. You can request export or deletion of your data at any time by contacting hello@productcreator.ai.

We may use anonymized, aggregated data to improve the Service, conduct research on product management practices, and develop benchmarks. Such data cannot be traced back to any individual.

6. Intellectual property

The productcreator.ai competency framework, assessment methodology, AI prompts, software, design, and content are the intellectual property of B2B Minds s.r.o. You may not reproduce, distribute, or create derivative works from any part of the Service without written permission.

Your assessment data and any content you provide remain yours. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

7. Payment and refunds

Certain features of the Service require payment (team subscriptions, expert assessments). Payments are processed via Stripe. Prices are displayed in EUR and are inclusive of applicable taxes unless otherwise stated.

For the expert assessment service, refunds are available if the session has not yet taken place. Contact us within 14 days of purchase for a full refund.

8. Limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that assessment results will be accurate or complete.

To the maximum extent permitted by law, our total liability arising out of or in connection with the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

In particular, we accept no liability for decisions made by you or your organization based on assessment results, whether generated by self-assessment, AI, managers, or experts.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, you may request export of your data within 30 days.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the Czech Republic. Any disputes arising from or relating to these Terms or the Service shall be resolved by the courts of the Czech Republic, specifically the courts in Prague.
